00:26:02 and groups she campaigned angri were subject to SDS targeting in the trch 2 Phase 2 period the right honoral Dame Jan rck PC is an anti- aparte campaigner and former chair of the campaign for
00:26:13 and former chair of the campaign for nuclear disarmament CND she was MP for depford from 1987 to 2015 and held several ministerial positions including Minister for woman Minister for the environment and Minister for energy and climate change documents disclosed in
00:26:28 climate change documents disclosed in this Tran of the inquiry show that CN with the subject of extensive surveillance by SDS officers both Diane abmp and Dame J Rod who I refer to as the core participants share a number of
00:26:39 the core participants share a number of concerns which they wish the inquiry to address in its in investigation of the SDS these developed concerns raised in
00:26:51 SDS these developed concerns raised in their opening statement for trch 2 Phase 1 and include one the targeting of MPS and the adequacy of disclosure two concerns over racial discrimination in the activities of the SDS three concerns over the use of
00:27:04 three concerns over the use of information gathered by the SDS and four procedural issues related to the inquiry turning to the targeting of MPS in the adequacy of disclosure reporting on MPS was a central concern in the
00:27:16 on MPS was a central concern in the creation of this inquiry in March 2015 in an urgent question in Parliament Peter Hayne requested that the remit of
00:27:27 Peter Hayne requested that the remit of the inquiry include the surveillance on MPS named by former undercover officer Peter Francis those included these called participants both of these called participants in fact spoke in the
00:27:38 participants in fact spoke in the subsequent debate the response from the minister for policing criminal justice and victims Mike Penning was that he would quote do everything I can to make sure that the documents are released end quote he went on to say that quote we
00:27:52 quote he went on to say that quote we have to find out exactly what went on that is what this inquiry must do the spying on MPS raises serious concerns over the erosion of the Wilson Doctrine against police surveillance of members of parliament inappropriate

00:29:28 statement of undercover officer hn 65 John Kerry who claims that quote elected politicians were exempt from the usual research and referencing proceded in oral evidence he was asked what he was taught by special Branch about reporting on npce and he said it wasn't clear but there was an indication that you
00:29:40 there was an indication that you wouldn't treat them as you would treat anybody else that you were reporting on you wouldn't automatically put them in reports and if you did it would only be if they were taking a leading role in
00:29:51 if they were taking a leading role in the larger event that you were reporting on and as such they didn't have they there were no records or files available on them so in Theory we weren't we weren't keeping
00:30:04 weren't keeping records this evidence however appears at odds with the oral evidence of hn 78 Trevor Morris he was taken to a report concerning the swp which mentioned Tony Ben addressing a meeting and asked why

00:30:31 doesn't slide away from the that an MP is involved in something you just report what there is that doesn't mean to say anything is going to happen anything is going to go anywhere it means that the desk officer has some knowledge and
00:30:42 desk officer has some knowledge and needs to have the knowledge of of what is what how it is happening what is going on what the background ground might be etc etc and as a desk officer when I was working such desks I would
00:30:53 when I was working such desks I would Hoover that up and see what I can use and what I can't use and the security service desk officers will do exactly the same he went on to confirm that this approach was used not withstanding the
00:31:06 approach was used not withstanding the fact that the subject of the report was a member of parliament he was later asked whether he ever saw a file on an elected politician and he said I was going to say hundreds many many many asked about the
00:31:20 many many many asked about the circumstances in which such files were kept he said well they are all marked secret which was more than special bran work any anyway the government position was as a minimum for that secret probably top secret they would be a
00:31:34 probably top secret they would be a special grants registry and they would relate to whatever it might be this reference to having seen many many many files on MPS appears to confirm the evidence of Peter Francis
00:31:47 confirm the evidence of Peter Francis about the extent of reporting on members of
00:31:48 of parliament an account of SDS reporting on members of parliament is also set out in the book Black Ops the incredible true story of a British secret agent WR by a former SDS officer using the pony
00:32:01 by a former SDS officer using the pony Carlton King the book states it is the job of the security service to vet and assess senior politicians the branch assisted with this Duty where and when required when the branch came across
00:32:13 required when the branch came across intelligence relating to politicians through its agents desk officers or SDS operatives Etc especially if it believed that the information could be utilized
00:32:26 that the information could be utilized by Soviet block iOS or other states to Blackmail or gain leverage against politicians to the advantage of these foreign powers it would pass this intelligence to the security service it was then up to the security service and
00:32:38 was then up to the security service and others to decide what should then happen unless it was purely criminal which would then be a matter for the police and criminal justice process this further supports the proposition that the SDS was involved in collecting information on members of
00:32:52 collecting information on members of parliament the core participants ask that these discrepancies are investigated during this Tran and in future tranches to ensure that the inquiry uncovers the full truth of what took place there are very significant different differences in the evidence
00:33:04 different differences in the evidence given by undercover officers it is all too easy for former undercover officers to claim that they only reported on MPS if they happen to speak to a group that
00:33:17 if they happen to speak to a group that they recovering this alone is enough to raise concerns about the propriety of reporting such events and would not explain the level of detail that is in that is contained in some reports about
00:33:28 that is contained in some reports about the contents of MP speeches and the like it is important that this area is fully explored with the managers that are due to give evidence in this phase of the inquiry next section concerns over
00:33:40 inquiry next section concerns over racial discrimination in the activities of the
00:33:41 of the SDS the home office guidance guidelines on the work of a special Branch produced by ra Harrington in 1984 set out the need for particular care in the
00:33:53 need for particular care in the operations of a special branch in areas connected to racial Justice and police accountability the guidelin State under the heading assistance to the security service that special Branch investigations into subversive
00:34:06 investigations into subversive activities in particularly sensitive fields for example in educational establishments in trade unions in industry and among racial minorities must be conducted with particular care so as to avoid any suggestion that
00:34:20 so as to avoid any suggestion that special branches are investigating matters involving the legitimate expression of views inquiries into subversive activities in these fields which may be NE necessary to meet the requirements of the security service should be initiated only after
00:34:37 should be initiated only after consultation with the security service it is not the function of the Force Special Branch to investigate individuals and groups merely because their policies are unpalatable or because they are highly critical of the police or because they want to transform the present system of police
00:34:49 the present system of police accountability not withstanding these guidelines there was extensive reporting on racial Justice campaigns and police accountability issues including groups in which Diane Abbott MP was involved
00:35:03 in which Diane Abbott MP was involved and we set out many in our opening to trch 2 phase one the failure to adhere to the guidelines is perhaps not unexpected since managers appear to have been
00:35:17 since managers appear to have been unaware of them as hn 61 States I am not aware of any of undercover officers having been instructed or advise not to collect data on individuals or organizations solely on the basis that such a personal organ ganization
00:35:28 such a personal organ ganization supports unpopular causes or on the basis of race or greed and only if it was necessary and relevant the annual reports for the SS
00:35:41 relevant the annual reports for the SS indicate that concerns over campaigns on racial issues were a key aspect of targeting the anti-nazi league a variety of local anti-racist and anti-fascist groups and predominantly black family
00:35:54 groups and predominantly black family Justice campaigns regularly feature in the groups targeted across the trch 2 era many of the reports produced during this period explicitly acknowledge that the groups spied on were not involved in disorder however the purported
00:36:06 disorder however the purported justification for infiltration appears to be concerned that these groups might be taken over by other organizations this assumption that black Le organizations could not preserve
00:36:19 Le organizations could not preserve their own independence displays racist attitudes that were present at the
00:36:32 attitudes that were present at the time moreover some officers such as hn8 viewed their deployment in h88 viewed his deployment in hacky as primarily geographically bed and did not have any direction towards particular groups groups which he infiltrated included Hackney CND Hackney campaign against
00:36:46 Hackney CND Hackney campaign against police Bill Hackney police monitoring group East London campaign against racist attacks and police harassment hn8 also reported on a wider selection of groups including the new monitoring
00:36:58 groups including the new monitoring project the newm seven or eight defense campaign the Colin roach defense campaign as well as several more minor Community racial Justice campaigns h88 States
00:37:10 States repeatedly in his witness statement that he did not view any of these groups as subversive and he did not witness public order concerns the danger of racial discrimination in a geographically based deployment targeting an area with a
00:37:22 deployment targeting an area with a large ethnic Min minority population is
00:37:34 large ethnic Min minority population is obvious many many similar concerns also arise from the deployment of hn 78 the relevant managers must be held to account for the instigation and continuation of such deployments without regard for the home office guidelines or concerns over racial bias which are clearly
00:37:51 clearly present turning to concerns over the use of information gathered by the SDS it's clear that throughout the TR 2 period the SDS worked hand in glove with the security service also clear that one of the primary per purposes of the security
00:38:06 the primary per purposes of the security service was vetting and the SDS played a crucial part in this as the security service witness y accepts vetting remained part of the services role throughout the TR 2 period and it is in my view highly likely that some possibly most of the information sought from SDS
00:38:18 most of the information sought from SDS officers was sought in order to be used for vetting purposes particularly where the service have asked STS officers for identifying information about individual members of subserved
00:38:40 members of subserved groups the security service influence on targeting is confirmed by relevant STDs managers for example hn 1115 Tony W states that the security service influenced our targeting decisions quite a lot most of our deployments were in in agreement with them we would always seek their views before deciding on new
00:38:57 targets it is also clear from documents disclosed to the inquiry that direct requests were made by the security services to the SDS to Target particular individuals and groups including CND these requests were often coupled to
00:39:17 these requests were often coupled to political and diplomatic concerns at the time many of those in the SDS appear to have been well aware of at least the potential use of SDS reports in vetting the vesting role of the security service and the SD's role in that was also confirmed in the book by Carlton
00:39:28 also confirmed in the book by Carlton King as already been seen he States in bold terms it is the job of the security service to vet and assess senior politicians and confirms that the branch assisted with that
00:39:42 assisted with that Duty there are also further concerns raised in the book about political influence on the S SDS by politicians at cabinet level he States the branch was only one Cog in the British State's
00:39:56 only one Cog in the British State's domestic National Security apparatus the security service MI5 was an even more Central component as was the home office the Judiciary the press and of course the politicians in particular cabinet
00:40:10 the politicians in particular cabinet level government ministers who sat at the center of this machine and could therefore tweak it to their advantage regarding the domestic use of information obtained from SDS sources
00:40:21 information obtained from SDS sources there are concerns that such information was passed to government ministers who clearly had a political interest in seeking to discredit CND there are also concern concerns conerns that information from SDS files was used for the purpose of vetting individuals for
00:40:32 the purpose of vetting individuals for political and othero appointments that past involvement in one of the largest anti-nuclear movements could inhibit the future career of those concerned is
00:40:46 future career of those concerned is reminiscent of the authoritarian regimes which the SDS and Security Services claimed to be fighting against the inquiry is asked to fully explore the use that was made of SDS reports for vetting purposes particularly in relation to politicians and civil
00:40:59 relation to politicians and civil servants my final section will address very briefly procedural issues and uh I echo in this opening statement the
00:41:13 echo in this opening statement the concerns which have been raised by many other core participants the disclosure in rule 9 process for TR 2 has been heavily delayed for the non-state core participants and that has had the effect of marginalizing their input and in many respects excluding them from effective
00:41:31 respects excluding them from effective participation the impact of these delays has almost exclusively been to the detriment of non-state core participants similarly the limitations on attendance at hearings has hindered
00:41:43 on attendance at hearings has hindered the engagement of the core participants in the inquiry these core participants represented here were not represented during the oral evidence of hn 78 Trevor Morris notwithstanding the significant
00:41:55 Morris notwithstanding the significant oral evidence he gave in relation to the targeting of members of parliament the inquiry is asked to ensure that procedural issues do not reduce the accountability of those responsible for the SDS the inquiry is asked to take steps to minimize the Prejudice to
00:42:09 steps to minimize the Prejudice to non-state core participants affected by the
00:42:09 the delays in conclusion the inquiry is asked to investigate the matters set out above the concerns raised by these core participants reflect wider concerns

00:43:30 statement uh so we make this statement on behalf of TBS whose mother Jackie had a long-term sexual relationship with Bob Lambert TBS was born in 1985 and his father posing as a
00:43:47 1985 and his father posing as a committed animal rights activist using the name Bob Robinson was involved in his life until 1988 when he disappeared abandoning TBS and TBS did not learn of the true
00:44:00 and TBS did not learn of the true identity of his father for further 24 years and so he did not find Art From
00:44:11 years and so he did not find Art From The Metropolitan Police as he ought to have done but from his mother piecing the events together from press reports since then he has been preoccupied by several aspects of his
00:44:26 preoccupied by several aspects of his life narrative and over the last decade he's been looking to this inquiry for explanation and
00:44:32 and accountability most painfully for him he wants to know why the Metropolitan Police Commissioner was prepared to let him live his entire life without knowledge of the true identity of his biological
00:44:44 biological father and whether there are any other children born in these circumstances who continue in ignorance he has set up the questions
00:45:00 ignorance he has set up the questions that this inquiry must answer concerning the commissioner's tolerance and or encouragement of deceptive sexual relationships the lack of supervision and governance of the undercover officers
00:45:12 officers deployments and the complicity of senior officers in the sub auge aimed at protecting Bob Lambert's identity from his own
00:45:21 his own son uh TBS has provided powerful testimony setting out the important to him throughout his life of learning more about his Origins the efforts he has
00:45:33 about his Origins the efforts he has made he made to do so in his youth the difficult process of reconciling himself to his biological father's absence and the profound and traumatic impact of

00:46:31 from delay and disclosure the first example we give sir is the fact that the evidence of potentially pertinent Witnesses has been concluded prior to TBS receiving
00:46:44 concluded prior to TBS receiving disclosure bearing on the circumstances of Bob Lambert's deployment his own early life the supervisory and governance structures of the SDS and the complicity of senior officers in the sub auge aimed at protecting Bob Lambert's identity from him in tbs's view the
00:47:00 identity from him in tbs's view the unorthodox approach to the marshalling of evidence for a public inquiry runs the significant risk of the truth being
00:47:14 the significant risk of the truth being obscured rather than eliminated by this process secondly in contrast with the position in earlier phases of this inquiry and as the issues that concern TBS come most into
00:47:25 TBS come most into Focus your inquiry has made a decision to limit tbs's legal funding his represent Representatives have been locked out of consideration of the evidence of Civilian Witnesses
00:47:38 the evidence of Civilian Witnesses including the evidence of his own mother the contentious evidence concerning the man Zed WB who it is said stood as tbs's
00:47:49 man Zed WB who it is said stood as tbs's godfa father in a non-religious ceremony and from those who have relevant evidence to offer concerning his early life including Belinda Harvey in this regard he has been placed in a position of gross and unjustifiable
00:48:01 of gross and unjustifiable inequity these experiences have undermined tbs's confidence in your inquiry sir and he endorses the analysis of the non-state non-p police Corp
00:48:15 of the non-state non-p police Corp participants opening statement that this is an inquiry in crisis TBS seeks reassurance that the inquiry will not take proactive steps to ensure that its dealings with him are conspicuous ly

00:48:44 personal development and sense of identity matters that will be under examination in this phase of your inquiry so we turn next to the commissioner's organizational responsibility the issue that TBS has
00:48:55 responsibility the issue that TBS has sought from the very outset to put at the Forefront of the inquiries investigation of his circumstances including the conduct conduct of the
00:49:07 conduct of the SDS and most importantly The Stance of Commissioners current and past in relation to him TBS has outlined in his witness statement quote the Metropolitan Police Service do not seem as an organization
00:49:18 Service do not seem as an organization to accept that in addition to planning to make sure these abuses did not happen once they had happened they had responsibility to try to minimize the
00:49:31 responsibility to try to minimize the impact to hold their hands up to accept
00:49:42 impact to hold their hands up to accept that they had allowed a toxic culture de to develop which led to these issues to acknowledge the wrongs done and to provide resources to help the victims such as me to access specialist
00:49:53 such as me to access specialist psychiatric and psychological help it feels scary that as an organization the Metropolitan Police Service were
00:50:06 the Metropolitan Police Service were happy for me to go through my whole life without knowing the true identity of my biological father and if it were not for the work of activists and journalists I would pre probably never have known the truth or had the chance to meet my biological
00:50:19 had the chance to meet my biological father the Metropolitan Police Service simply left me alone to deal with all of this both before and after I learned of Bob Lambert's true
00:50:37 identity the commissioner in his opening statement yesterday commun communicated an apology to TBS for the distress he has suffered growing up not knowing his true parentage for the fact that the Metropolitan Police Service should not have allowed Bob Lambert to behave in
00:50:49 have allowed Bob Lambert to behave in the way that he did and committing to ensure that TBS receives answers to his questions during this
00:51:09 questions during this inquiry as to that apology TBS asks you so to note that while IT addresses Bob Lambert's conduct it does not address the organizational responsibility of those who knew of tbs's existence in the years and decades following his birth and it does not address the
00:51:26 and it does not address the commissioner's own failings in relation to tbs in the period leading to and following Bob Lambert's
00:51:32 exposure in relation to the answers he seeks so you will recall that at paragraph 101 of his written statement TBS invites the Metropolitan Police

00:51:57 of cander addressing the chronology of the organization's awareness of first the developing public interest in the SDS in general and Bob Lambert in
00:52:15 general and Bob Lambert in particular secondly when it became aware that there was a significant likelihood that Bob Lambert's true identity would be disclosed publicly thirdly the time by which it
00:52:27 publicly thirdly the time by which it was or ought to have been obvious that Bob Lambert's identity would become known to
00:52:32 known to TBS and finally any decisions taken or explanation for the failure to make decisions regarding the need to notify
00:52:45 decisions regarding the need to notify Bob Lambert's identity identity to TBS before his mother pieced the evidence together from press reports so TBS seeks that evidence and invites your inquiry to compel it should it not be Vol
00:52:56 it not be Vol volunteered because of the simp simp Le fact that it was unconscionable for the Metropolitan Police Service to leave TBS and his mother to find out the truth in the manner in which they
00:53:08 manner in which they did by maintaining the status quo the commissioner facilitated the grave and continuing infringement of tbs's Rights causing him irrevocable
00:53:21 causing him irrevocable harm and again we invite you sir to consider the submissions provided as to the legal framework and specifically the rights enshrined in statute at common
00:53:34 rights enshrined in statute at common law and in both the European convention on human rights and the United Nation convention on the rights of the child because so these events did not occur in a legal
00:53:45 a legal vacuum on the contrary there have been pronouncements at the highest judicial level that the best interests of children are not served by the concealment of of
00:53:57 concealment of of truth that it is to be implied that a child such as TBS who shows a genuine interest in his true parentage suffers mental and psychological suffering
00:54:10 mental and psychological suffering through obfuscation of the truth that such suffering does not diminish with age and that the shock at discovering
00:54:22 age and that the shock at discovering the truth about one's Origins at a later stage will be increased by the realization that the child has been caused to believe a falsehood that in the words of Lord Hudson in
00:54:34 Hudson in 1972 sir quote the interests of Justice are best served by the ascertainment of the truth and there must be few cases
00:54:50 the truth and there must be few cases where the interests of children can be shown to be best served by the suppression of
00:54:55 Truth the domestic and international Court have also recognized that knowledge of one's true identity positively contributes to personal de
00:55:07 positively contributes to personal de development to one's sense of self and there are also of course important practical consequences including in relation to knowledge of potential hereditary medical
00:55:18 hereditary medical conditions it follows that had the Metropolitan Police Service sought advice at the time of tbs's birth or at any stage
00:55:29 any stage subsequently they would have been advised that notifying TBS of his true parentage was in his best interests the question for your inquiries sir is why other
00:55:48 inquiries sir is why other considerations were permitted to Prevail long after it became apparent that the truth would OD the uncomfortable reality is that it will be within this very inquiry that TBS will learn facts that ought not to
00:56:05 TBS will learn facts that ought not to ever have been obscured from him facts regarding his childhood and early development and it is for this reason that the Restriction upon his funding attracts a special
00:56:19 attracts a special appropriate so you are referred to tbs's statement you will note the tragic attempts to learn more about the fiction that was Bob Robinson to
00:56:28 to identify uh with that fiction about the efforts of his mother and grandparents to protect him from the
00:56:40 and grandparents to protect him from the abandonment and how TBS has struggled to come to terms with reality that his understanding of his parentage was based on a
00:56:50 on a lie to suppress his identification with the non-existent Bob Robinson and to come to terms with the true identity of Bob

00:57:17 was built around the scale and the depth of the de deception perpetrated upon TBS is truly extraordinary and deeply deeply shocking the impact upon TBS of this deception

01:02:34 the dead children's identities was disrespectful to their memories and the commissioner has apologized all the families for this and for the Metropolitan police's failure to stop that misconduct from occurring those remarks are of course

01:04:47 senior officers within the Metropolitan Police were fully aware of the practice but did not take any steps to stop it for two decades nor to close the SDS in the context of your robust findings from trunch one the F families also looked to the inquiry to identify
01:05:03 also looked to the inquiry to identify whether the assertions that there was no alternative um or credible assertions and to establish the extent of wrongdoing associated with the
01:05:17 practice the families also note that you reserved your findings in trunch one regarding the impact of the practice and
01:05:29 regarding the impact of the practice and they are grateful for the opportunity to assist with understanding of the de Devastation that this practice has wrought on their families and how the memories they all cherish have been tainted tainted and tarnished by
01:05:43 tainted tainted and tarnished by it although it is very painful for them to do so being able to speak out publicly about the practice has been a small measure in ensuring that the wider public are aware of the cost to the
01:05:55 public are aware of the cost to the these families but it is an important one few officers turn their minds to the inevitable impact on the families and
01:06:11 inevitable impact on the families and the families Express hope that through their participation in this inquiry through their testimonies the profound consequences of those actions will be brought to light and contribute to ensuring that the

01:06:44 1983 and 1992 who had their loved ones cruy used are Frank Bennett and honor Robson in relation to the abuse of their brother Michael Harley's
01:06:55 Michael Harley's identity Faith Mason in relation to her son Neil
01:06:56 son Neil Martin Marva and Judy Lewis in relation to their brother Anthony Lewis and Kaden Blake in relation to her brother Matthew
01:07:07 Blake in relation to her brother Matthew rer each of these families have provided evidence of the devastation wrought upon them families that were already made vulnerable by the premature premature
01:07:23 vulnerable by the premature premature loss of a child or a young adult in the family um but those families represent only a small proportion of the victims of identity threat theft by the Metropolitan Police in this
01:07:38 period further in their pursuit of accountability the families have scrutinized the practices of the undercover officers including those who appropriated their loved ones identities and they looked to the
01:08:01 identities and they looked to the inquiry to ask the questions required to bring to light our unit at the heart of the Metropolitan Police could employ such tactics over such a prolonged period without sanction or consequence as further explained in the written statement the family's concern about the use of the Dead children's
01:08:13 about the use of the Dead children's identities does not rest with the fact of the exploitation alone but includes understanding the extent of the
01:08:24 understanding the extent of the intrusion into their own lives and how the identities were used they are concerned that in taking a child's identity the officers went on to research and use details from the
01:08:40 research and use details from the family's private and family lives so as to test their identity choice and to build their Legends and they are concerned that the purposes to which the children's names were put debased their memories and further that not a care was
01:08:55 memories and further that not a care was given to the risks to which the families were thereby themselves
01:09:02 exposed as with other issues under examination in this inquiry the family's concern having considered the evidence is that the inquiry is not being given the full
01:09:15 inquiry is not being given the full truth and that for the reason set out in some detail in the written statement um there was in fact extensive intrusion into their lives as envisaged in the tradecraft manual
01:09:26 in the tradecraft manual officers did not put the dead children's identities to the service of the greater good a phrase that we take from Kaden Blake's
01:09:39 Blake's statement officers went far beyond acceptable conduct seducing women enaging themselves into the lives of others attending parties and weddings and even celebrating the birthdays of
01:09:59 and even celebrating the birthdays of dead children as if they were the their own officers also committed criminal offenses in the names of the dead children misled other state bodies in the
01:10:08 the process appeared in court as Witnesses or defendants in the children's names the officers were instructed by managers to quote remain within the process that is to maintain Reliance
01:10:24 process that is to maintain Reliance upon the dead children's identity if arrest
01:10:30 arrest did hn1 suggests that he was advised that the remedy for misleading the courts was to ensure that he did not quote lie in evidence but he offers no
01:10:41 quote lie in evidence but he offers no commentary upon the fundamental lie as to
01:10:46 to Identity they undermined lawful and legitimate protest movements for the Lewis family it was especially bitter to learn about TR Trevor Morris's activity ities in the words of Marvel Lewis it
01:10:59 ities in the words of Marvel Lewis it was quote deeply upsetting that Trevor Morris sought to undermine campaigns for race racial Justice while quote pretending to be my
01:11:11 pretending to be my brother he said that quote from our perspective it seems that he had stolen the identity of a deceased young black
01:11:26 the identity of a deceased young black boy and his work under cover contributed to undermining the investigation into the racist murder of another black boy Steven
01:11:39 Lawrence the deplorable Association of this conduct with their LED ones names is a significant factor in their dismay that so many officers continue to enjoy
01:11:51 that so many officers continue to enjoy anonymity as it Remains the dead child's identity with which that misconduct will be forever
01:12:02 be forever Associated and not the identity of the officer who was responsible for the
01:12:10 misconduct the families regret that they too consider it necessary to register this afternoon for disappointment with the manner in which the inquiry has engaged with them to date detail has
01:12:25 engaged with them to date detail has been set out in their written statement but this afternoon they emphasized one aspect
01:12:28 aspect only which is that they have in substance been shut out from disclosure as to the nature and scope of the extensive restrictions that have been applied to evidence concerning the
01:12:44 applied to evidence concerning the practice and they are concerned that onerous restriction orders over historical practices are impeding the inquiries investigations into relevant
01:12:56 inquiries investigations into relevant matters of importance to the Ames and to the
01:13:00 the Future us sir have directed that any attempt to challenge the restrictions which were applied without reference to the families is quote discouraged and quote would almost certainly result in the existing
01:13:16 certainly result in the existing restrictions being upheld and that it is quote very unlikely that the inquiry would extend funding for the purposes of any such
01:13:26 any such scrutiny and the family's concerns are of
01:13:29 of predetermination and a conflation of the inquiry's judicial and administrative
01:13:43 inquiry's judicial and administrative functions the families consider that the inquiry's decision-making processes are operating to exclude them the families do not consider that they have been placed on an equal footing to the police Corp participants nor do they consider that the open just Justice principle is being complied with
01:13:56 being complied with these problems are of course at their most acute in relation to the restricted family a family who have been required to participate in this inquiry
01:14:09 to participate in this inquiry anonymously by reason of a restriction order covering their own identity as well as that of the Dead child and the rail and cover identity of the
01:14:24 rail and cover identity of the officer the restricted family feel silenced and disempowered by the inquiries process by being denied the opportunity to speak openly about the trauma they have
01:14:35 openly about the trauma they have suffered in contrast with other families who gained some control through being able to speak art and the restricted family's hopes
01:14:46 art and the restricted family's hopes that this inquiry might expose the truth and achieve a measure of accountability have rapidly faded in conclusion sir the fam's wish
01:15:00 faded in conclusion sir the fam's wish to align with Council to the inquiries obser obervation that the inquiries investigations are not a purely historical exercise the commissioner has now acknowledged that it was wrong to
01:15:13 acknowledged that it was wrong to justify immoral and unlawful behavior on the basis that they would not quote get found
01:15:14 found out you sir are encouraged by the families to ensure that this principle extends beyond the Reliance upon dead children's identities

01:16:20 submission by Kirsten Heaven on behalf of the uh nonp police uh nonstate core participants thank you sir good afternoon I hope you've been provided with a copy of my Al opening there may be a few tweaks but not many hopefully this is the opening statement on behalf of the cooperating non police
01:16:38 on behalf of the cooperating non police non-state cor participant have expressed a view for tranch to phase who I will refer to as the non-state group this supplements the statements that have been made directly on behalf of non-state individuals and groups by
01:16:49 non-state individuals and groups by their instructed lawyers and the group's opening statement for tranch 2 Phase 1 now before I touch upon the evidence for t to P2 I want to make some initial observations if I may on the opening
01:17:02 observations if I may on the opening statement made on behalf behalf of the Metropolitan Police Service in that statement the MPS accepted and repeated what was stated on behalf of the commissioner at the start of T2 P1
01:17:13 commissioner at the start of T2 P1 namely that there had been management failures and misconduct by undercover officers in the SDS in tranch 2 as you
01:17:24 officers in the SDS in tranch 2 as you heard just a moment ago from Miss Fiona Murphy King's Council The NPS acknowledged in its written opening statement for T2 P2 that the misconduct of undercover officers whilst using the identities of deceased persons was
01:17:42 identities of deceased persons was disrespectful to their memories and The NPS apologized for its failure to stop this misconduct from occurring noting that the language used in the SDS tradecraft manual was dehumanizing and wholly
01:17:57 dehumanizing and wholly unprofessional the MPS also acknowledged yes yesterday and in writing that the actions of h78 Trevor Morris in deceiving two women inter sexual relationships was quote unequivocably unacceptable these are important
01:18:08 unacceptable these are important Admissions and they are welcomed but for the reasons set out a moment ago by Miss Murphy some of them do not go far enough the non-state group have other
01:18:21 enough the non-state group have other concerns arising from The Stance being taken by the MPS in T2 P2 despite making Admissions and despite
01:18:34 despite making Admissions and despite taking corporate responsibility for what the MPS describe as quote systemic management failing within the SDS the MPS are now seeking to persuade this inquiry that the question of justification must be assessed without
01:18:48 justification must be assessed without reference to these failings and without reference to the misconduct in the words of the MPS and I quote there was a clear justification for covert infiltration of the militant
01:19:00 for covert infiltration of the militant aspects of the animal rights movement in the
01:19:00 the 1980s but the fact that undercover officers participated in crime and engaged in sexual misconduct are issues that are distinct from the primary
01:19:13 that are distinct from the primary question as to whether the deployments were Justified at the outset the non-state group are deeply disappointed that the MPS now appears to be seeking to minimize the abor
01:19:27 be seeking to minimize the abor behaviors of SDS undercover officers and the failures of the SDS managers by suggesting that these matters are not Central to the issues you must consider
01:19:43 Central to the issues you must consider sir The NPS are wrong on this issue and put simply abor behavior and systemic managerial failure are matters that clearly go to the heart of the question of
01:19:49 of justification the non-state group therefore urged the inquiry to firmly reject the hypothetical and entirely artificial approach to the question of justification as proposed by the
01:20:01 justification as proposed by the MPS the truth is that from the very start of their deployments in tranch 2 the SDS managers directed undercover officers to engage in speculative
01:20:16 officers to engage in speculative deployments characterized by extensive collateral intrusion they knew undercover officers were involved in criminal activity and taking on positions of responsib ility
01:20:28 taking on positions of responsib ility that they were cohabiting with activists and engaging in duplicitous sexual relationships SS managers even directed undercover officers to mislead the court and facilitate miscarriages of
01:20:40 and facilitate miscarriages of Justice many of these behaviors have been defended by undercover officers in
01:20:52 been defended by undercover officers in this inquiry as being essential to doing their job in other words essential to acquiring the so-called intelligence sought by their SDS managers to in turn justify the deployments all of this occurred in a
01:21:04 deployments all of this occurred in a context where there was no proper system or practice for assessing and reassessing the justification and proportionality of SDS targeting so so on this topic the
01:21:16 targeting so so on this topic the non-state group once again remind the inquiry of the approach taken to justification by the investigatory Powers tribunal in the case of Wilson
01:21:28 Powers tribunal in the case of Wilson versus the MPS in that case the court analyzed justification interia by considering the nature of the authorizations and the safeguards and scrutiny and oversight by the MPS of the undercover officer in question in its
01:21:41 undercover officer in question in its judgment the court was critical of the broad open-ended quality of the authorizations and the wholly inadequate
01:21:55 authorizations and the wholly inadequate attempts to balance the highly intrusive nature of the surveillance and the Very obvious potential for and ity of collateral intrusion so the non-state group maintain that the abor tradecraft of SDS undercover officers and the widespread
01:22:08 undercover officers and the widespread fishing Expeditions engaged in by them could never have been Justified even despite the so-called militant aspects of the animal rights movement so you've already made clear in your tranch one interim report that the
01:22:23 your tranch one interim report that the overarching question of justification of the SDS
01:22:25 the SDS must be considered alongside the means they employed to get to the ends in your words sir in tranch one the means
01:22:36 words sir in tranch one the means employed by the SDS did not justify the ends and I want to make some limited comments on the evidence the inquiry is shortly to hear in T2 P2 the inquiry
01:22:53 shortly to hear in T2 P2 the inquiry will examine the deployments of hn10 Bob Lambert hm 5 John dyes hn2 Andy Kohl's and hn1 Cen Matt raino these undercover officers have engaged in some of the most abor abusive cruel and morally repugnant behavior in
01:23:08 cruel and morally repugnant behavior in the history of the SDS yet despite this sincere and genuine remorse is lacking by way of just one example Andy Kohl's continues to deny to this day that as a
01:23:20 continues to deny to this day that as a 32y old man he groomed Jessica when she was a 19-year-old teenage girl into having a long-term sex ual relationship with him whilst deceiving her into believing amongst other things that he was 24 years old this is despite his
01:23:34 was 24 years old this is despite his former employer The NPS accepting that Andy cold did have a relationship with Jessica the inquiry will know that like Trevor Morris and Roger Pierce upon
01:23:49 Trevor Morris and Roger Pierce upon leaving the MPS Bob Lambert and Andy Kohl's have sought to further their careers by projecting a public Persona of respectability and professionalism relying and talking up their secretive special Branch past the inquiries should
01:24:05 special Branch past the inquiries should therefore approach the evidence of these former undercover officers with great skepticism these former officers may be under the illusion that they still have reputations that they need to protect
01:24:24 reputations that they need to protect the inquiry knows that Lambert has an MBE for services to policing and has previously reinvented himself as a university lecturer there is also Andy Kohl's another aspiring novelist trading on his time as an undercover
01:24:37 time as an undercover officer Kohl's was also a former deputy police and crime commissioner for Cambridge and Peterborough a former local counselor and a school governor
01:24:50 local counselor and a school governor who even had the audacity to spearhead a campaign to protect young people from sexual
01:24:52 sexual exploitation these former officers may also still feel disgruntled about their
01:25:03 also still feel disgruntled about their so-called work not having been properly recognized for example Andy coold told SDS Management in his six-month post-operational debrief I feel disappointed that I received no recognition for the sacrifice made not
01:25:16 recognition for the sacrifice made not just by me but for my wife and family as well that there is no over recognition for that effort from our da ACS ACC or the commissioner gos
01:25:30 the commissioner gos me in tranch 2 SDS undercover officers and managers describ the practice of closing ranks to protect one another Bob Lambert has described undercover
01:25:43 Lambert has described undercover officers being quote Bound by the strong bond of loyalty that arises naturally within the field and hn9 Malcolm shearing has referred to himself as a whistleblower as mentioned in the category H opening statement delivered
01:25:55 category H opening statement delivered to the inquiry yesterday today evidence shows that former undercover officers are being selective about what to reveal to this inquiry continuing to remain loyal to their colleagues Beyond those who are deceased or
01:26:07 who are deceased or already largely discredited the non-state group condemns such con conduct and so should the inquiry the t2 P2 disclosure also
01:26:21 inquiry the t2 P2 disclosure also reveals as you've heard a bit about already that there was a cabal of undercover offic centered around Bob Lambert dihn 109 tells the inquiry that Lambert was quote a charismatic
01:26:37 Lambert was quote a charismatic attention seeker and he quotes John dyes as having stated that quote rules are made to be broken whilst both Lambert and dines met with their SDS managers to discuss their deployments more frequently than other undercover officers dihm 109 also
01:26:52 undercover officers dihm 109 also considers that in hindsight that in his view this was part of their quote self-promotion hm122 C Neil Richardson referred to Lambert as quote quite
01:27:04 referred to Lambert as quote quite unique with an attitude of entitlement such that he quote demanded commendations this is a description that apply aligns with Lambert's membership of the cabal an idea of himself as a
01:27:23 of the cabal an idea of himself as a quote Elite undercover officer Lambert's involvement in serious criminality and miscarriages of Justice will be dealt with by the affected individual nonp police stakehold participants but of note dhn1 uh hn 61 Chris Hy's evidence is that Lambert was an exception and
01:27:35 is that Lambert was an exception and that because he had received an award for his undercover work quote there was nothing anyone could say against
01:27:46 nothing anyone could say against him the inquiry now knows from Lambert himself that he was awarded a commendation in part in Reliance on intelligence he was able to gain directly from Jackie after having deceived her into a sexual
01:27:57 deceived her into a sexual relationship in his written evidence to the inquiry Lambert has shown no remorse or acceptance that he procured a
01:28:08 or acceptance that he procured a commendation through cruel deception of both Jackie and the MPS and through abusive and morally repugnant Behavior as the category H opening statement observes Lambert has not returned his
01:28:22 observes Lambert has not returned his Commendation or his MBE for services to policing
01:28:24 policing it therefore comes as no surprise to learn that hm1 Mike chitty referred to Lambert as quote a professional liar who has stabbed people in the back Lambert
01:28:36 has stabbed people in the back Lambert was also an undercover officer able to engage in some of the most extreme and shocking forms of deception and duplicity for example Lambert claims to
01:28:50 duplicity for example Lambert claims to have spent his academic career trying to quote establish what the record is in terms of the animal rights movement in the 1980s referring to it as quote a very serious
01:29:02 very serious business yet there's evidence that when undercover Lambert brought his then one-year-old son TBS to the hopefield Animal Sanctuary where he met with members of the animal rights
01:29:13 members of the animal rights movement when discussing his own deployment in media appearances lamber stated that he had quote no intention to Target the women he was asked about and with whom he had relationship ships
01:29:27 with whom he had relationship ships putting these relationships down instead to weakness and irresponsibility the inquiry must be alive to attempts by Lambert to Fain Contrition after the event or to come up with a false narrative seeking to deny
01:29:40 with a false narrative seeking to deny the deliberate use of deceitful sexual relationships as an SDS tradecraft Miss Kroy King's Council on behalf of the
01:29:51 Kroy King's Council on behalf of the cater H core participants powerfully set out yesterday before the inquiry some of the motivations behind the actions of Lambert in his treatment of Belinda Harvey in particular um and she
01:30:08 Belinda Harvey in particular um and she mentioned and talked about his desire to seek out sexual gratification and have extramarital sex with a younger woman whilst treating her personal life like a fantasy game World the inquiry must also be alive to attempts by Lambert to control and
01:30:22 attempts by Lambert to control and manipulate the narrative Lambert has form in this regard in September 2013 before this inquiry was established but at a point in which it was
01:30:31 it was contemplated Lambert used his academic position to publish a self-serving excal
01:30:43 position to publish a self-serving excal patry academic article to defend himself under the guise that he was publishing academic research on quote community-based approaches to counterterrorism Lambert used this
01:30:55 counterterrorism Lambert used this article amongst other things to warn against the that others were quote seeking to encourage police investigators to see me as a controlling and manipulative figure at the heart of systemic police
01:31:08 systemic police malpractice now Lambert's real intention appeared to be to use the article to promote the reliability of officer- Le investigations such as operation Hearn um in which he argued that they were sufficient to quote get to the truth
01:31:21 sufficient to quote get to the truth within the same article Lambert also sought to justify his deployment against his Target groups and attempted to make
01:31:36 his Target groups and attempted to make an artificial distinction in relation to his SDS deployment describing it quote as concealment and perhaps a lack of transparency but not deception and lying Lambert wrote this article in the very same month that he was being interviewed by operation Hearn and it is significant that his witness statement
01:31:50 significant that his witness statement for this inquiry now seeks to backtrack on several earlier admissions the fact Lambert thought it was appropriate to use his academic position in such a manner speaks volumes
01:32:03 position in such a manner speaks volumes about the lengths to which he will go to protect his reputation it also highlights Lambert's willingness to transgress principles of conduct and integrity even in his academic
01:32:17 academic career the non-state group further noted that in the same academic article Bob Lambert States quote I will not write my own full account in response to
01:32:29 own full account in response to undercover and dispatches until I first discharge my legal obligations to the investigations and Court proceedings the non-state group query what else Lambert has left to stay to say within a full account beyond that which he has provided in his witness
